Terms and conditions of use
YOUR USE OF AND ACCESS TO OUR SERVICES (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS OUR SERVICES IN ANY MANNER. If You accept or agree to these Terms and Conditions of Use on behalf of a company or other legal entity, You represent and warrant that You have the authority to bind that company or other legal entity to these Terms and Conditions of Use and, in such event, "You" and "Your" will refer and apply to that company or other legal entity in addition to You. Please read these Terms of Use carefully before using our Services
"At the customers discretion Grim Workshop extends shipping protection on each order that the customer can opt into. This shipping protection extends coverage to online purchases at Grim Workshop that are lost, or damaged while in transit for the order to which the package protection was selected for. This protection is on a per-order basis and does not cover additional shipments beyond the initial order. Shipping Protection allows for up to one replacement of a product (or order, if applicable) that has been lost or damaged while in transit.
As a customer of Grim Workshop your election to add shipping protection to your order is entirely optional. Your shipping protection does not cover the following without specific written permission from Grim Workshop.
Orders over $2,000 in value who opted into shipping protection, orders that have been lost, damaged, or stolen more than once per purchase of shipping protection, orders that have been seized by customs, claims that are suspected of being fraudulent, orders suspected of being fraudulent or placed under false pretenses, orders from users who have filed more than 3 claims in a 12 month period, Any order that exceeds our shipping protection limit will not be covered by Grim Shipping Insurance without written permission from Grim Workshop
Shipping protection claims for packages marked "delivered" must be filed after 5 days and before 30 days from the date the package was marked "delivered"
Shipping protection claims for packages presumed lost, not marked as "delivered" must be filed after 7 days and within 30 days from the last checkpoint.
Should a claim be approved
The Claimant guarantees that it is the person or entity entitled to payment and agrees to cooperate with and to assist Grim Workshop in effecting such recovery, to include providing all documentation or other information which may be needed by Grim Workshop and to execute in the customer's name any documents which may be necessary to carry into effect the purpose of this agreement.
If a claim is accepted by Grim Workshop the items, or order that has been lost or damaged will be replaced and re-shipped (without additional shipping insurance to cover a second incident).
Grim Workshop reserves the right to deny claims that are suspected as being made under false pretenses or without merit, and delay the re-shipment of a claim if we determine there is a reasonable chance that the order may still arrive in a timely manner.
At Grim Workshops sole discretion, consumers who violate these terms and conditions or who otherwise pose an unacceptable risk of loss as determined by Grim Workshop may be designated as an uninsurable risk. Following proper notification of such designation, Grim Workshop may rescind the insurance product from affected individuals and/or orders and any collected premium will be refunded. Your use of Shipping Protection through Grim Workshop is further subject to the following additional restrictions:
You represent, warrant, and agree that You will not contribute any content or otherwise use our Services or interact with our Services in a manner that:
Infringes or violates the intellectual property rights or any other rights of anyone else (including us); Violates any law or regulation, including any applicable export control laws; Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable or that otherwise interfere with the proper working of our Services (including by placing an unreasonable load on our Services' infrastructure). A violation of any of the foregoing is grounds for immediate termination of Your right to use or access our Services. Grim Workshop reserves the right to deny a claim based on their discretion.
UNDER NO CIRCUMSTANCES WILL GRIM WORKSHOP BE LIABLE TO YOU FOR MORE THAN THE TOTAL AMOUNT PAID TO GRIM WORKSHOP FOR SHIPPING PROTECTION BY YOU DURING THE ONE-MONTH PERIOD PRIOR TO THE ACT, OMISSION OR OCCURRENCE GIVING RISE TO SUCH LIABILITY AND THE REMEDY OR PENALTY IMPOSED BY THE STATUTE UNDER WHICH SUCH CLAIM ARISES.
Grim Workshop shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
